Terms of Service

Welcome to HaiTales. These Terms of Service (“Terms”) govern your access to and use of our website, products, and services. By using HaiTales, you agree to these Terms.
1. About HaiTales
HaiTales creates personalized, AI-illustrated children’s photo books. You upload a photo of your child, we generate an illustrated character, weave them into one of our stories, and ship a printed book to you. Print fulfillment is handled by our partner Gelato. The service is operated by HaiTales, a registered DBA (“doing business as”) based in Los Angeles, California, USA (“we”, “us”).
2. Accounts
You can preview a sample without an account. To purchase a full book, you must create an account with a valid email address. You are responsible for the activity on your account and for keeping your credentials secure. You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
3. Content you upload
When you upload a photo, you confirm that (a) you have the legal right to use the photo for this purpose, (b) you are the parent or legal guardian of the child shown, or have explicit permission from one, and (c) the photo does not depict another person’s child without authorization. You retain all rights to your photo. You grant us a limited, worldwide, royalty-free licence to process the photo solely to generate, print, and ship your book.
4. AI generation and accuracy
We use AI image generation (currently OpenAI) to produce the illustrated character and to compose each page. AI outputs vary; the character is an artistic interpretation, not a portrait, and individual pages may vary in detail. Because the look of your character and pages is an AI styling choice rather than a manufacturing fault, it is not treated as a print defect (see “Returns, refunds, and reprints” below).
5. Prices, payments, and taxes
Prices are shown on each product page in U.S. dollars. We accept payments through Stripe. You authorize the charge at checkout, and the order is placed once payment clears. Any applicable sales tax, VAT, or duties are added at checkout based on your shipping address.
6. Shipping and delivery
Books are printed on demand and shipped through our fulfillment partner. Typical production and shipping time is 5–10 business days, depending on destination. Shipping costs and any customs fees are shown at checkout. Title and risk of loss pass to you on delivery.
7. Returns, refunds, and reprints
Each book is personalized and printed on demand, so all sales are final: we don’t offer returns or refunds simply because you changed your mind or would have preferred a different result. If your book arrives with a genuine manufacturing or shipping defect — for example a misprint, a binding error, missing or duplicated pages, or damage in transit — contact us within 30 days of delivery with a photo of the problem. We will first reprint and reship a corrected copy at no charge; if a corrected reprint isn’t possible or doesn’t fix the issue, we’ll refund you in full. Differences that come from AI styling (see “AI generation and accuracy” above) are not defects. If you’re unhappy with a book that isn’t defective, we still want to hear from you — at our discretion we may offer a partial refund or a discount on a future order as a goodwill gesture, though this isn’t guaranteed. Nothing in this section limits any rights you have under the consumer-protection laws of your country of residence that cannot be waived by contract.
8. Acceptable use
You agree not to upload photos that (a) depict nudity, abuse, or content harmful to children, (b) infringe anyone’s rights, (c) include any person’s likeness without their consent, or (d) violate any law. We may refuse, cancel, or refund any order that we believe violates these rules.
9. Intellectual property
Book text, illustration templates, prompts, brand assets, and the website are owned by HaiTales or our licensors. We grant you a personal, non-commercial licence to use the finished personalized book you purchase. You may not resell, reproduce, or commercially distribute the book or its contents.
10. Limitation of liability
To the maximum extent permitted by law, HaiTales is not liable for indirect, incidental, special, or consequential damages. Our total liability for any claim arising out of or related to the service will not exceed the amount you paid us for the order in question.
11. Changes to these terms
We may update these Terms from time to time. We will post the updated version on this page with a new “last updated” date. Material changes will be communicated by email or a notice on the site. Continued use of the service after the update means you accept the new Terms.
12. Governing law
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Disputes will be brought exclusively in the state and federal courts located in Los Angeles County, California — except where mandatory consumer-protection laws of your country of residence give you the right to bring proceedings in your local courts.
